Making a purchase

Just browse our store, and add any items that you wish to buy into the shopping basket. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

Product descriptions and pictures should only be used as a guide. The product pictures are for illustration purposes only. We regularly check to insure the pictures on our website are accurate, but due to the manufacturer changes etc., the products you receive may vary from the picture on our website. We will always send you the latest products that are available from our suppliers.

As we purchase a lot of our products to order it is not possible for us to indicate stock levels on our website. If you would like to check the availability of a product, then please contact us before placing an order. MissMySupermarket.com cannot guarantee the supply of any one product.

Should any item be out of stock, our customer services will call or email to see whether a substitute can be accepted. To prevent delay for dispatch please reply as soon as possible. When ordering 10 or more of the same product please give us at least 5 working days so that we can make a special order with the supplier.

All the product weights listed on our site are approximate content weights & are there for a guide only. The weights do include the contents packaging weight & any additional packaging weight that may be required. These weights are subject to change at any time, as we are always checking and updating product weights. Our couriers also calculate the volumetric weight of parcels, so large light weight items can incur additional postage costs.

For usage instructions and safety guidelines always read the product label. If you are unsure about any product, then please contact the manufacture before purchasing.

We always carefully select all our products to ensure the longest possible best before date. Any fresh food such vacum packed cheese or bacon (special request) will be dispatched at the clients risk and descretion.

PURCHASE OF ALCOHOL

Alcoholic drinks can be purchased on this website. By agreeing to these terms and conditions, you confirm that if purchasing alcohol you are of at least the minimum legal age required by your Country to purchase and consume alcohol. IF YOU PURCHASE ALCOHOL YOUR DATE OF BIRTH MUST BE ENTERED IN THE CUSTOMER CONTACT DETAILS WHEN REGISTERING YOUR ACCOUNT

We accept credit card payment. If you are shopping from outside the UK your credit card company will convert the transaction to your own currency.

We accept Visa, MasterCard, Visa Debit, Amex , Maestro and PayPal via our secure payment processor. (Worldpay) We do not currently add charges to credit card payments.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

You can pay for your order using your credit card via our secure payment processor Worldpay.com. Just follow the simple instructions on our website. If a refund is due, it will be made in full if you paid via credit card. PayPal refunds will be made for the full amount less the charges made by PayPal, to us, when we first received the payment.

We can also 'manually' take credit card details over the phone, please call 01452 610608 and have all the correct details at hand.

Returns Policy:

Under the EU Distance Selling Directive which can be found at
http://www.legislation.gov.uk/uksi/2000/2334/contents/made, you have the right to return certain goods by advising us of your cancellation in writing within 14 working days of your order being delivered, and is subject to the following conditions:

1) The goods remain in their original condition and packaging and have not been tampered with in any way.
2) The cost of returning the goods rests with you, the buyer.*
3) We regret that we cannot accept general returns of perishable foodstuffs or products which may pose a hygiene/health risk, such as baby formula, or any items which have been ordered/commissioned to your personal specifications.*

AVAILABILITY AND DELIVERY

We aim to dispatch your online (food) supermarket order within 48 hours of receipt and it should be with you within 2-15 working days of dispatch. Estimated delivery transit times are clearly marked within the site.

If you are using our MAIL FORWARDING service, we will have to take advice from the customer, you, for when we are to expect your goods to arrrive to us. We then contact you to say we have taken receipt, collated and dispatched the goods.

Where a product is out of stock we will offer you a refund or, where you have agreed, provide a substitute product.

When ordering 10 or more of the same product please give us at least 5 working days so that we can make a special order with the supplier.

All descriptions, product images and weights are those of the original manufacture and are intended to give a general description of the goods. The weight to be shipped includes the weight of packaging for the goods.

RISK AND TITLE

The Products will be at your risk from the time of delivery.

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

PLEASE NOTE FRESH FOOD CLASSED AS PERISHABLE IS NOT INSURABLE  AND CUSTOMER'S ORDER AT THEIR OWN RISK. FLUIDS OF ANY KIND ARE ALSO NONE INSURABLE AND CUSTOMER AGAIN ORDERS AT THER OWN RISK. SHOULD LIQUIDS LEAK AND SOIL OTHER ITEMS WITHIN THE PARCEL WE OR THE CARRIER WILL NOT BE HELD RESPONSIBLE.

Insurance: PLEASE NOTE: CARRIERS NOW DEEM ALL FOOD PRODUCTS AS PERISHABLE GOODS AND ARE NOW NON INSURABLE.

PRICE AND PAYMENT

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

If we have made a pricing error by displaying a lower price than the correct price, we will either contact you for instructions before dispatching the Product or reject your order and notify you of such rejection. If the pricing error is unmistakeable, we are under no obligation to provide the Product to you at the incorrect (lower) price.

If we have incorrectly displayed a higher price, we will confirm the correct price to you in the Dispatch Confirmation and refund the difference to your card.

We will charge your credit or debit card at the time of checkout.

All payments shall be made in United Kingdom pounds sterling. Please note that MissMySupermarket.com cannot be held responsible for adverse currency fluctuations. The conversion rate is set at the point of authorisation of your credit/debit card.

Prices shown exclude Vat where Vat is applicable. Prices with Vat content are clearly marked within the Product information page.

OUR REFUNDS POLICY

When you return a Product to us:

(a) because you have cancelled the contract between us within the seven-day cooling-off period, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, excluding the cost of sending the item to you. You will also be responsible for the cost of returning the item to us;

(b) because the Product is defective, we will examine the returned Product and replace it or provide a refund. Products returned by you because of a defect will be refunded in full, excluding a refund of all delivery charges.

PLEASE NOTE: FRESH FOOD IS CLASSED AS PERISHABLE IS NOT INSURABLE  AND CUSTOMER'S ORDER AT THEIR OWN RISK. FLUIDS OF ANY KIND ARE ALSO NONE INSURABLE AND AGAIN PURCHASER ORDERS AT THEIR OWN RISK. SHOULD LIQUIDS LEAK AND SOIL OTHER ITEMS WITHIN THE PARCEL WE OR THE CARRIER WILL NOT BE HELD RESPONSIBLE. PERISHABLE FOOD IS EXEMPT FROM DISTANCE SELLING REGULATIONS.

If you make a mistake whilst ordering we will be unable to offer a refund on any returns or postage. If the mistake is ours, then we will refund, resend or replace the items concerned. If your parcel is returned to us with an attempted delivery, or due to you providing incorrect address details, we will have to re-charge you the shipping costs to re-ship your order. If you decide to not have your order re-shipped then we cannot refund the cost of the good purchased.

OUR LIABILITY

We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

We are not responsible for indirect losses which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether caused by tort (including negligence), breach of contract or otherwise.

This does not include or limit in any way our liability:

(a) For death or personal injury caused by our negligence;

(b) Under section 2(3) of the Consumer Protection Act 1987;

(c) For fraud or fraudulent misrepresentation; or

(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
